Q2: There is a practice followed by the owners of land in which people have invested as partners. May Allah guide them. When they sell a piece of land, they retain a small percentage of it. This percentage serves as an excuse for them so that they do not pay the partners all of their rights. Is what these people are doing permissible?
A2: If the situation is as described, it is not permissible for the land traders who have partners to retain any part of the land in order to cheat the partners and thereby not give them their full rights. Indeed, this is a delay in delivering rights, and it is injustice. The Prophet (peace and blessings be upon him) said: It is agreed upon that it is authentic. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
