Praise be to Allah alone, and blessings and peace be upon the one after whom there is no prophet. And after:
The Permanent Committee for Scholarly Research and Ifta has reviewed what was sent to His Eminence the Grand Mufti from the honorable Shaykh: Salah ibn Muhammad al-Badir, the judge of the Dammam High Court, with number (4705) and date 12/8/1419 AH, along with the inquiry submitted by one who used the initials (A - K - M), and referred to the Committee by the General Secretariat of the Council of Senior Scholars, with number (5186) and date 18/8/1419 AH. The inquirer asked a question, the text of which is as follows: Allah the Exalted says:[Al-Baqarah 2:278] and the hadith of Muslim : . It mentions among them: (the consumer of riba) and the hadith of Abu Dawud: Sahih Muslim 1598 . Question: I am an employee responsible in the Employee Affairs Department of one of the government sectors. The salaries of the employees of this sector are paid out via checks on one of the private banks. We received instructions from the higher authorities that if one of the department's employees agrees with one of the private banks on a personal loan from these banks, then
the department responsible for paying salaries (the Employee Affairs Department) gives the borrower, the beneficiary of the loan, a letter to the lending bank under the signature of the Manager of the Employee Affairs Department, stating that the department has no objection, according to the agreement concluded with the bank, to the transfer of the beneficiary's salary directly to the bank for the entire period agreed upon for paying the installments due in exchange for the value of the loan. It is not hidden from your eminence that all loans granted by these banks carry riba interest. We ask Allah the Most High, the Great, to keep us and you away from forbidden things. Our question is: Is our signing of these letters considered participating with them in sin, and does that fall under the matter of writing mentioned in the noble hadith? Even though, as a responsible person, I advise everyone that these are matters that Allah has forbidden and it is not permissible for you to proceed with them, but to no avail. I hope for your eminence to answer my question.
After studying the inquiry, the Committee answered that this work is haram because it is dealing in riba and cooperating in it. Allah has forbidden riba in all its types and threatened with the most severe warning for it, including riba in loans, whether from banks or from others. The Prophet (peace and blessings be upon him) cursed the consumer of riba, the one who facilitates it, its witnesses, and its writer. So he (peace and blessings be upon him) cursed the one who consumes riba and the one who assists in consuming it. And Allah the Exalted said:
[Al-Ma'idah 5:2] Therefore, it is obligatory for everyone to be cautious of what Allah has forbidden, to advise one another, and to inform the authorities about those who do not accept advice and continue to deal in riba, so that action can be taken against them. And success is from Allah, and may Allah send blessings and peace upon our Prophet Muhammad, his family, and his companions.
