Q: As you know, in Algeria we have what is called: (legislative elections). There are parties that call for Islamic governance, and there are others that do not want Islamic governance. What is the ruling on a voter who votes for other than
Islamic governance, even though he prays?
A: It is obligatory for Muslims in countries that do not rule by the Islamic Shari'ah to exert their efforts and do what they can to rule by the Islamic Shari'ah, and to unite as one hand in supporting the party that is known to rule by the Islamic Shari'ah. As for supporting one who calls for not applying the Islamic Shari'ah, this is not permissible; rather, it leads its supporter to disbelief. This is based on the saying of Allah the Exalted:[Al-Ma'idah 5:49-50] . Therefore, when Allah made clear the disbelief of those who do not rule by the Islamic Shari'ah, He warned against supporting them or taking them as allies, and He commanded the believers to fear Allah if they are truly believers, saying the Exalted: [Al-Ma'idah 5:57]
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.

(50) Then is it the judgement of [the time of] ignorance they desire? But who is better than Allah in judgement for a people who are certain [in faith].
وَأَنِ احْكُمْ بَيْنَهُمْ بِمَا أَنْـزَلَ اللَّهُ وَلاَ تَتَّبِعْ أَهْوَاءَهُمْ وَاحْذَرْهُمْ أَنْ يَفْتِنُوكَ عَنْ بَعْضِ مَا أَنْـزَلَ اللَّهُ إِلَيْكَ فَإِنْ تَوَلَّوْا فَاعْلَمْ أَنَّمَا يُرِيدُ اللَّهُ أَنْ يُصِيبَهُمْ بِبَعْضِ ذُنُوبِهِمْ وَإِنَّ كَثِيرًا مِنَ النَّاسِ لَفَاسِقُونَ (49) أَفَحُكْمَ الْجَاهِلِيَّةِ يَبْغُونَ وَمَنْ أَحْسَنُ مِنَ اللَّهِ حُكْمًا لِقَوْمٍ يُوقِنُونَO you who have believed, take not those who have taken your religion in ridicule and amusement among the ones who were given the Scripture before you nor the disbelievers as allies. And fear Allah, if you should [truly] be believers.
يَا أَيُّهَا الَّذِينَ آمَنُوا لاَ تَتَّخِذُوا الَّذِينَ اتَّخَذُوا دِينَكُمْ هُزُوًا وَلَعِبًا مِنَ الَّذِينَ أُوتُوا الْكِتَابَ مِنْ قَبْلِكُمْ وَالْكُفَّارَ أَوْلِيَاءَ وَاتَّقُوا اللَّهَ إِنْ كُنْتُمْ مُؤْمِنِينَAnd success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
