Q6: What is the status of the lawyer in the Islamic judicial system, since, as is customary, he attempts by every means to obtain a ruling in favor of his client?
A6: The status of the lawyer in the Islamic judicial system is that he is the agent (wakil) for the party he represents in the dispute, whether the plaintiff or the defendant. It is obligatory for him and his client to be moderate in seeking the truth and to be just to the opposing party. If they adhere to this, it is better for them, and it assists the judge in adjudicating disputes. If the opposing party or his agent refuses to do so and resorts to deception and stubbornness in the dispute, out of their greed and desire for victory, even if it is through falsehood, and to secure earnings, even if from what is forbidden, then they have committed a sin and consumed the wealth of people unjustly, and they have placed the judge
in confusion and bewilderment between them, unless Allah the Exalted saves him by His grace and mercy, and guides him to the straight path, so that he adjudicates the dispute with truth. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
