The questioner : I am a twenty-six-year-old married man, but since my marriage I have been living an unhappy life, because I married this wife for the sake of my younger brother, who wanted to marry her younger sister, and her father insisted on not marrying him to her unless the older sister married, and when I felt that my brother would lose his future because of this girl, I married the older sister, and I hate her, and now I want to divorce her, so is there a sin on me for that, because I know that the most hated of lawful things to Allah is divorce, knowing that I have spent seven years with her, which were the worst years of my life, and because of her I left my country to work here in the Kingdom, and for four consecutive years I have not returned to it, and I have had a daughter from her, so is that permissible for me? And is there a sin on me for boycotting her for that long period?
The Shaykh : As long as you can be patient with her, patience is better, due to the saying of Allah the Exalted:[An-Nisa 4:19] Especially since she has given birth to a daughter for you, if you were to separate from her, there would be danger in that for this girl, that she would be lost between you and her mother and the husband who marries her after you, and therefore patience is better for you.
As for your absence from her for four consecutive years, she has the right, as long as she has not demanded it from you and you are confident or reassured about her in her country, then there is no blame on you for staying this period, and if you fear for her in her country or she demands your presence, you must be present, unless your staying here is a necessity for seeking a livelihood, in which case you are excused for that, and you may give her a choice after this and say: if you wish to be patient with this, and if you wish, I will make it easy for you.
The Shaykh : As long as you can be patient with her, patience is better, due to the saying of Allah the Exalted:
For if you dislike them - perhaps you dislike a thing and Allah makes therein much good.
فَإِنْ كَرِهْتُمُوهُنَّ فَعَسَى أَنْ تَكْرَهُوا شَيْئًا وَيَجْعَلَ اللَّهُ فِيهِ خَيْرًا كَثِيرًاAs for your absence from her for four consecutive years, she has the right, as long as she has not demanded it from you and you are confident or reassured about her in her country, then there is no blame on you for staying this period, and if you fear for her in her country or she demands your presence, you must be present, unless your staying here is a necessity for seeking a livelihood, in which case you are excused for that, and you may give her a choice after this and say: if you wish to be patient with this, and if you wish, I will make it easy for you.
