Q1: I used to have intercourse with my wife every day, but I thought to myself that I would not have intercourse with her for a week, and I intended to do so next week. I secretly swore an oath saying, "Divorce is upon me." In the middle of the week, I had intercourse with her and said to myself, "I will carry out the oath in another week." I actually carried out the oath. Did the oath take effect, making it the first divorce, or did it not take effect? Please inform us of the answer and what is required of me?
A1: If the situation is as you described, that you did not pronounce the divorce aloud or in secret, nor did you swear by it, but it was only a thought in your mind, then it has no effect. Nothing is entailed by it, neither a divorce nor an expiation. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
