If he gives his wife the choice and intends divorce

Machine translationRead the Arabic original
The first question of Fatwa No. ( 5048 )
Q1: A man married a woman and had (5) children with her, then
this woman was afflicted with a mental illness, so this man married a second woman. After the sick woman recovered, her husband said to her: "Choose between the following two options: 1- That you remain with your children. 2- That I take you to your family" . I intended by this choice to divorce her, and this woman chose to remain with her children, and I am the one who provides for her while she lives with her children. I ask for your guidance

A1: If the situation is as you described, that you intended to give her the choice between staying with her children or staying with her family, thereby divorcing her, whether she stayed with her children or with her family, then one divorce takes effect on her. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
