Question 6 from Fatwa No. ( 2742 )
Q6: In our country, we have a custom where men and women mix in the house, for example, and there are foreign men present, and the women do not observe hijab in front of any of the men in that country, whether they are from that same country or from another country, and the woman goes out displaying her adornment, and she meets the men while she is in her adornment, and she does not cover her face or her hands or her hair either, and sometimes the clothing does not cover much of her body beyond the face and hands, such as the chest, the arms, and the legs. Some of us get married while working in a country far from that country, and he orders his wife to observe hijab, but is it permissible if she returns to that country where this custom exists to leave off the hijab, and there are many
women who refuse to observe hijab and say: All the women of my community do not observe hijab, so I will never observe it; because the woman who observes hijab is mocked by the other women, and they increase their comments and mockery against her because she has left the custom that the other women here follow. Also, the men mock and consider this hijab strange to them, and they say to the husband of the woman who ordered his wife to observe hijab: Our custom is like this, especially the husband's relatives, such as the husband's brother or his relative, or the man whose brother married this woman who observes hijab from him. And because, especially if the woman observes hijab from them, they are upset by this hijab, and they say: We are relatives, and it is permissible for this woman to uncover herself to us, and she should not observe hijab from us. They consider this hostility from the man who ordered his wife to observe hijab from them because they are his relatives, and with them the custom is that women like these do not observe hijab from them absolutely, and they eat from the same plate as if they were mahrams. We hope for information on this matter, and whether the customs we mentioned are permissible or must this custom be fought. And if the wife refuses to observe hijab, what is the ruling? Does he stay with her or divorce her? Please inform us, may Allah reward you with good. And this is an important issue, and it is necessary to draw your attention to this town, and also the attention of all Muslims, where I believe you do not expect that in this country of the Kingdom there is anyone who does this, knowing that there
are no bodies for enjoining good and forbidding evil, and no one who forbids them from this custom except a few from some students of knowledge, but they do not number more than one, especially those who fight this custom. But they insisted on remaining with this custom, and they say: This is the custom of our fathers and grandfathers, and we are like them, and we cannot leave this custom ever. We hope for clarification with precision due to the importance, and thank you.
A6: It is forbidden for a woman to uncover her face in the presence of non-mahram men according to the correct of the scholars' opinions, and it is forbidden for her to uncover her hair or her chest or her neck or her arms or her legs or the like of her body in the presence of non-mahram men by the consensus of the Muslims, and it is forbidden for her to be in seclusion with men other than her mahrams, as it is forbidden for her to mix with non-mahrams in a way that leads to fitnah. The many proofs from the Book and the Sunnah indicate this in a way that leaves no room for doubt in its prohibition. And those in whose countries the custom is contrary to this, they must strive to remove it, and they must cooperate in eradicating it and getting rid of its evil; to preserve chastity, and to cooperate in righteousness and piety. And they must persist in enjoining good and forbidding evil, and continue with it, and let no one's blame deter them in supporting the truth and refuting falsehood, and let not
mockery or ridicule prevent them from it. And perhaps Allah will purify the lands through you from the evil and corruption that befalls them. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and his Companions.
