The fee for goldsmithing

Machine translationRead the Arabic original
The first, second, and fifth questions of Fatwa No. ( 5937 )
Q1: A goldsmith takes a fee for working on gold, and this is done either in the form of selling gold and receiving its price along with the fee, or exchanging gold for gold and taking the fee for the work, including his profit.
A1: Taking a fee for working on gold along with the value of the item sold is permissible if it is sold for something of a different type, such as paper currency. However, if it is sold for something of the same type, such as gold for gold, while taking a fee, it is not permissible. This is based on what is established in the two Sahihs from Abu Sa'id al-Khudri (may Allah be pleased with him), that the Prophet (peace and blessings be upon him) said:
Do not sell gold for gold, except like for like, and don't increase something of it upon something; and don't sell silver unless like for like, and don't increase some thing of it upon something, and do not sell for ready money something to be given later.
Sahih Muslim 1584a
. Q2: He sells old gold as if it were new (meaning: it has not been worn yet)
This is done either in the form of a condition that was stipulated, or implicitly, and he will be charged the price of the new item. In this case, taking the fee for the hallmark, which is only taken for new items (this hallmark fee is taken by the government in exchange for hallmarking the gold after verifying that it is 21 or 18 karat, and they take it from the goldsmith, and the goldsmith takes it from the buyer, and this is only for new items).

A2:
O you who have believed, fear Allah and be with those who are true.يَا أَيُّهَا الَّذِينَ آمَنُوا اتَّقُوا اللَّهَ وَكُونُوا مَعَ الصَّادِقِينَ
[At-Tawbah 9:119]

Whoever cheats us is not one of us.من غشنا فليس منا
Sunan Ibn Majah 2225Da'if (Darussalam)

Q5: Regarding the sale of rings and bands to men, does only the seller sin, or is the price he took forbidden?
A5: Selling rings and bands to men made of gold and silver is permissible. However, if you know that the man will wear that gold ring, do not sell it to him; because in this case, it falls under the category of cooperating in sin. You must advise him and inform him that wearing gold for men is forbidden.
