Fatwa number ( 11746 )
Q: Our father (may Allah have mercy on him) passed away and did not bequeath anything from his wealth after his death, and he left behind a farm with date palms in it, and he had no debt, praise be to Allah. Then his heirs reached the age of maturity and donated from the date palms he left for them, and from the land attached to his farm, one-third, and they wrote a waqf (endowment) for him, to be spent on a sacrificial animal or two sacrificial animals for him, and whatever remains is for righteous deeds and reward from Allah. Is this donation permissible in the Shari'ah? Please give us a ruling, may Allah reward you, and may Allah preserve you.
A: If the matter is as mentioned, that the heirs are of sound mind and donated by their own free will, then the donation is valid and they will be rewarded. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
