Fatwa No. ( 13874 )
Q: A person of good standing in al-Hafar al-Batin built a large mosque with an area of (30 × 42) and built a prayer hall for women at the rear of the mosque with an area of (5 × 25), and built two rooms for the imam and the mu'adhdhin. The mosque is where the Jumu'ah prayer is performed, and it was built about three years ago. Recently, some of the mosque's congregation gathered a sum of money and wanted to expand the women's prayer hall so that the congregation could pray in it at all times except Jumu'ah, knowing that they had been praying in it. The person of good standing who built it objected to them and said: "I built the mosque so that it would be used for prayer at all times, and leaving it without prayer would be a neglect of it. I wish for the prayer in it to be constant, and for the prayer hall to be for women only." Some of the mosque's congregation insisted on their idea, which is to expand the women's prayer hall so that they can perform all prayers in it, and leave the mosque for the Jumu'ah prayer only. They presented the matter to us, and I wished to present it to your Eminence so that the matter is concluded and becomes
a rule to be followed in the future, and may Allah preserve you
A: It is obligatory that the matter remain as it was originally, so that the prayers and Jumu'ah are performed in the mosque, and the women's area remains for women, even if it is expanded; to realize the public benefit and to carry out the intention of the endower who donated to its construction. May Allah multiply his reward, and may Allah guide your Eminity and assist you in all good. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
