Pledging Land

Machine translationRead the Arabic original
Fatwa No. ( 14514 )
Q: I proposed to a girl who is a relative of mine. I am in my first year at the Faculty of Commerce. The reason for this was that my mother is unable to do anything, as she has reached the age of sixty-six, in addition to the marriage of my only sister and the suffering my mother endured in raising us. My father passed away in 1970, and at that time I was five years old, my brother Muhammad was three, and my sister Kheira was seven. We owned nothing but a small house and a half-fadlan on lease, meaning
The lessor, and my mother raised us by the grace and favor of Allah, who never left us in that regard, until my sister got married and graduated from the Faculty of Commerce in 1989, and my brother from the industrial school diploma. My mother was stricken with illness and advanced age, and became unable to do anything, which led me to propose to this girl who is close to us so that she could help my mother. Now that I have graduated from university and received a military exemption due to the removal of my spleen following a surgical operation, and my brother is unemployed, all we do is farm half a feddan. However, the length of the engagement increased, which led the girl's family to tell me: "Decide on a position by the end of December. All we ask for is a bedroom, meaning the minimum, but I am not able to afford it." After thinking it over, my brother and I agreed to pledge a piece of land so that we could buy the bedroom. But all I want is clarification: is pledging a piece of land forbidden or lawful? Some say here: it is forbidden, and some say: your circumstances remove the prohibition from you. So should I pledge the piece of land and marry this girl who will care for my mother after my sister's marriage, or should I leave her to her own devices? And is it forbidden for me if I leave her? I call upon Allah, Mighty and Majestic, to guide you to what is best for the Muslim community
and all Muslims throughout the earth, as I also call upon Allah, Mighty and Majestic, to look upon us and provide for us.

A: First: It is obligatory for you to be dutiful to your mother and to treat her kindly to the best of your ability, especially since she has reached old age and needs assistance and support. Second: If the land is owned by you or your brother and he has given you permission to pledge it, then it is permissible to pledge it to buy a room for your residence with your wife. And success is from Allah, the Exalted. We ask Him to expand your provision and to help everyone with what brings Him pleasure. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
