The first question of Fatwa No. ( 1644 ):
Q1: I have debated some of those who issue rulings permitting prayer in the cemetery and in the mosque that contains a grave or graves, and I have refuted their doubts with the atomic bombs—the clear, authentic hadiths—but they said: Where was Aisha (may Allah be pleased with her) praying after the Messenger of Allah (peace and blessings be upon him) and others were buried inside her house, inside or outside? They also said: How is it that the Messenger of Allah (peace and blessings be upon him) and his Companions prayed in the Sacred Mosque , and Hagar , the wife of Ibrahim (peace be upon him), and some of the prophets were buried in it? Therefore, I ask you, O honorable Shaykh, to inform me whether it is true that they mentioned regarding the presence of Hagar in the Sacred House and some of the prophets, and whether it is true that Aisha used to pray in her house after the death of the Messenger of Allah (peace and blessings be upon him), and to direct me to some books that discuss this?

Vol. 1: It is established in the two authentic collections from 'A'ishah (may Allah be pleased with her) that she said: The Messenger of Allah (peace and blessings be upon him) said in the illness of his death, from which he did not recover:
Allah cursed the Jews and the Christians that they took the graves of their prophets as mosquesلعن الله اليهود والنصارى اتخذوا قبور أنبيائهم مساجد

She said, 'A'ishah (may Allah be pleased with her):
He warned against what they did, and had it not been for that, he would have exposed his grave, but he feared that it would be taken as a mosqueيحذر ما صنعوا، ولولا ذلك لأبرز قبره ولكن خشي أن يتخذ مسجدًا
And in the authentic collection of Muslim , from Jundub ibn 'Abd Allah , from the Prophet (peace and blessings be upon him) that he said five days before he died:
Beware of those who preceded you and used to take the graves of their prophets and righteous men as places of worship, but you must not take graves as mosques; I forbid you to do that.ألا وإن من كان قبلكم كانوا يتخذون قبور أنبيائهم وصالحيهم مساجد، ألا فلا تتخذوا القبور مساجد، فإني أنهاكم عن ذلك

And in [the authentic collection of Muslim ] also, he said:
Do not sit on the graves nor perform Salat towards them.لا تجلسوا على القبور ولا تصلّوا إليها

God’s messenger forbade that graves should be plastered with gypsum, that any erection should be built over them, and that people should sit on themونهى صلى الله عليه وسلم أن يجصص القبر وأن يبني عليه وأن يقعد عليه

, so he cursed the Jews and the Christians ; because they took the graves of their prophets as mosques, and the Prophet (peace and blessings be upon him) forbade taking graves as mosques, and praying toward them, and building upon them; to protect the sanctity of the oneness of Allah, and to block the means to associating partners with Allah. And by this it is known that mosques built over graves are not permissible to pray in, and their construction is forbidden. As for what came in the question from the questioner's statement: Where did 'A'ishah (may Allah be pleased with her) pray after the Messenger of Allah (peace and blessings be upon him) and others were buried in her house, inside her house or outside?
The answer is: Aisha (may Allah be pleased with her) is among those who narrated the established hadiths from the Messenger of Allah (peace and blessings be upon him) regarding the prohibition of taking graves as mosques, and this is from the wisdom of Allah (Exalted and Majestic is He). By this, it is known that she did not pray in the room where the graves were; because if she had prayed in it, she would have been contradicting the hadiths she narrated from the Messenger of Allah (peace and blessings be upon him), and this is not befitting of her, but rather she prayed in the rest of her house. By what we have mentioned, it is known that he (peace and blessings be upon him) was not buried in the mosque, but rather he was buried in his house, but when al-Walid ibn Abd al-Malik expanded the mosque of the Messenger of Allah (peace and blessings be upon him), he included the room in the mosque, so some people who came after that thought that he (peace and blessings be upon him) was buried in the mosque, and that is not the case, and the Companions (may Allah be pleased with them) are the most knowledgeable people about his Sunnah (the Prophet's way), so for this reason they did not bury him in his mosque but rather in his house; so that it would not be taken as a mosque. As for the claim that Hagar is buried in the Sacred Mosque or other prophets, we do not know of any evidence indicating that, and as for those who claimed that among the historians, their statement is not relied upon; due to the lack of evidence indicating its truth. And success is from Allah. And may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
