The first question of Fatwa No. ( 3315 ):
Q1: What is the ruling on praying in mosques that contain graves and shrines?
Volume 1: It is not permissible for a Muslim to pray in mosques built over graves. The basis for this is the evidence indicating the prohibition of building mosques over graves, including what is established in the two Sahihs from A'ishah (may Allah be pleased with her), that Umm Salama mentioned to the Messenger of Allah (peace and blessings be upon him) a church she had seen in the land of Abyssinia and the images in it, and he said:Sahih al-Bukhari 434 , and among them is what was narrated
The narrators of the Sunan from Ibn Abbas (may Allah be pleased with them both), who said:Jami` at-Tirmidhi 320Da'if (Darussalam) , and it is established in the two Sahihs from Aisha (may Allah be pleased with her) that she said: The Messenger of Allah (peace and blessings be upon him) said: Sunan an-Nasa'i 703Sahih (Darussalam) . And success is from Allah. And may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
