The Shaykh : And I am giving you a simple example of how the Sunnah grants its adherent a jurisprudence that others do not find, those who are content with studying the branches of jurisprudence, who do not study the Sunnah from which the branches are derived, but rather study the branches that are not connected to the principles, namely: the Book and the Sunnah. Before I mention the example that came to my mind, I will mention to you a story or a wisdom, it is better to call it a wisdom, from one of the jurists of Andalus, and he is Ibn Rushd al-Andalusi, who said: "The example of the mujtahid and the example of the taqlid follower is like the example of the maker of slippers and the seller of slippers": The example of the taqlid follower and the mujtahid is like the maker of slippers and the seller of slippers.
He said: "A man comes to the seller of slippers, and he has different types and sizes hanging in the front of the place. A man comes with a foot size that is strange and not customary among people": So it is, for example, short and large and wide, short and large, almost square, for example. We see wonders in the creation of Allah. He comes to the seller of slippers, and he is merely one who sees this size, and he says to him, "Excuse me, I do not have it." There is no need for him to search. Perhaps another person comes, and there is a possibility. What is the size? For example, the length is forty, what is the width? By Allah, the width is ten. The brother searches and does not find it. Who is this? The seller of slippers.
As for the maker of slippers, he comes to him and shows him the size, and he takes it and cuts it according to his way, and he prepares it for him. Why? Because he is a maker and not a taqlid follower seller.
That one is like the taqlid follower, and this one is like the mujtahid, meaning: that the mujtahid is able to find from the Book and the Sunnah evidence that he derives from them for some of what happens over the course of time.
The example that came to my mind and I wanted to mention to you contains a lesson for what we are in, and also a proof for what we are in:
Filling of the molars, filling of the molars is the profession today among those who are called dentists. It was not known in that time. So, is it permissible for a Muslim to fill his molar?!
In this issue, there are two opinions: some say: it is permissible, and some say: it is not permissible. So these are the fanatical Hanafis who did not understand the Book and the Sunnah, but rather they analogize to some opinions that were mentioned in the branches of the detailed books.
