The questioner : The sender, Muhammad ibn Ali al-Jabali, says: In the city of Iman in Yemen, there is a woman called al-Sindiyah who is twenty years old. She steals people's money, and many ignorant people visit her to ask about expatriates, what is wrong with them and when they will return. The sick also visit her for healing. When they are with her, she brings a cover and places it over herself, then says in a changed voice, "So-and-so will come after so many days or months, or he will not come." She says the sick person so-and-so will be healed, and this is a charm for him, or the charm will not benefit him. She tells women what their husbands are keeping from them, to the point that my wife went to her and told her, "Your husband is thinking about marrying." So my wife sent me a message asking for her divorce papers, and I sent them to her, and in them was the khul' with three [divorces]. Is this divorce valid or invalid? Please note that it has been six months, and I do not know the reason? This woman claims that she has noble jinn who inform her, and she often tells men, "Your wives have men other than you," to create discord between wives and their husbands. Are there noble jinn who know the unseen? Please inform us accurately about this matter?

The Shaykh : Praise be to Allah. This woman is a fortune-teller because she claims to know about the future. Anyone who claims to know the future is a lying fortune-teller. It is not permissible to go to her, nor is it permissible to believe her. In fact, believing her is a denial of the Qur'an. Allah the Exalted says:
Say, "None in the heavens and earth knows the unseen except Allah قل لا يعلم من في السماوات والأرض الغيب إلا الله
[An-Naml 27:65]
The unseen is what is hidden from humans regarding future matters, and no one knows it except Allah Mighty and Majestic. This woman who claims this is also denying the Qur'an. Therefore, the rulers must prevent such matters in their lands so that they do not lead people to what contradicts their creed and what denies the words of Allah and His Messenger (peace and blessings be upon him).

The questioner : O Allah, send blessings and peace upon him.

The Shaykh : As for what this woman claims of knowledge of the unseen, it is never permissible to believe it. If it happens that some of what she reports comes to pass, that is only by coincidence or by something overheard from the heavens, and she adds several lies to it to cover up her falsehood.

The Shaykh : As for what she claims of communication with noble jinn, this is also a false claim, because the fortune-teller must be denied in everything he says and all the effects he mentions regarding his fortune-telling.

The Shaykh : The jinn do not know the unseen by the explicit text of the Qur'an. Allah Mighty and Majestic says:
And when We decreed for Solomon death فلما قضينا عليه الموت
[Saba 34:14]
meaning Solomon (peace be upon him).

So no one knows the unseen, neither from the jinn, nor from the angels, nor from humans
Say, "None in the heavens and earth knows the unseen except Allah قل لا يعلم من في السماوات والأرض الغيب إلا الله
[An-Naml 27:65]
And He the Exalted and Majestic said:
(26) [He is] Knower of the unseen, and He does not disclose His [knowledge of the] unseen to anyone (27) Except whom He has approved of messengers, and indeed, He sends before each messenger and behind him observers عالم الغيب فلا يظهر على غيبه أحدا إلا من ارتضى من رسول فإنه يسلك من بين يديه ومن خلفه رصدا
[Al-Jinn 72:26-27]

The Shaykh : In Sahih Muslim, from the hadith of Ibn Abbas (may Allah be pleased with him), he said: "The triple divorce in the time of the Prophet (peace and blessings be upon him) and the time of Abu Bakr and two years of the caliphate of Umar" He said: "The triple divorce was one [divorce]. When people became hasty in this matter, Umar (may Allah be pleased with him) said, 'I see that people have hastened in a matter in which they used to be patient. If we were to enforce it upon them.'" This is an explicit text that enforcing the triple divorce as a final divorce is an act of independent legal reasoning by the Commander of the Faithful, Umar (may Allah be pleased with him).

The Shaykh : Just as this is the requirement of the text, it is also the requirement of reasoning, because the triple divorce is a matter for the Shari'ah, not for the human. If a person says, "I seek forgiveness from Allah three times," or "Glory be to Allah three times," or if he says after the prayer, "Glory be to Allah, praise be to Allah, there is no god but Allah, Allah is the Greatest," and then says thirty-three times, he is not credited with thirty-three.

The Shaykh : If this does not happen in matters that are desirable and beloved to Allah Mighty and Majestic, which is being rewarded for His remembrance and obedience, how can it be in matters whose utmost is that they are permissible, such as divorce? Therefore, it is not befitting... meaning, the correct reasoning and analogy requires that the triple divorce is one [divorce].

The Shaykh : Thus, it is supported by the text and by reasoning, just as Allah the Exalted and Majestic said to His Prophet:
O Prophet, when you [Muslims] divorce women, divorce them for [the commencement of] their waiting period يا أيها النبي إذا طلقتم النساء فطلقونهن لعدتهن
[At-Talaq 65:1]

The Shaykh : Divorce for the waiting period is only when the woman is with her husband, meaning not already divorced, because if she is divorced after being divorced within the waiting period, she is not divorced for the waiting period. For this reason, the scholars (may Allah have mercy on them) say that if a man divorces his wife today, and after she has menstruated twice, he follows it with a second divorce, she does not restart the waiting period with this second divorce. This indicates that it is a divorce not for the waiting period. And if it is a divorce not for the waiting period, it becomes not commanded, because Allah says:
Divorce them during their waiting period. طلقوهن لعدتهن
.

He who did any act for which there is no sanction from our behalf, that is to be rejected. من عمل عملا ليس عليه أمرنا فهو رد

And the Shaykh al-Islam Ibn Taymiyyah (may Allah have mercy on him) held the view that the triple divorce, even if in separate words, does not take effect as more than one, unless a taking back or a new marriage contract intervenes.
