Transmission: Mutawatir and Ahad, and that a report is not accepted until it is famous, even in legal rulings.

Machine translationRead the Arabic original
The questioner : We discussed in it, meaning it is valid in it, how transmission is... the path of transmission... and mutawatir transmission or ahad transmission... When I mentioned to one of the scholars this hadith that I cited in "Al-Silsilah al-Sahihah."

The Shaykh: Do you mean fame?

The questioner: Yes.

The Shaykh : Fine; what is its fame?

The questioner : They say, for example, this is contrary to the action...

The Shaykh: What is the action?

The questioner : They say we used to do it with the Prophet (peace and blessings be upon him), and he said: He used to order us to make du'a and so on.

The Shaykh: This is a hadith from the Messenger.

The questioner : (peace and blessings be upon him), yes.

The Shaykh
When one of you sits for the tashahhud, let him say in every two rak'ahs: The tahiyyat إذا جلس أحدكم في التشهد فليقل في كلِّ ركعتين : التحيَّات
to the end of it
Then let him choose from the supplications whatever he wishes. ثم ليتخيَّر من الدعاء ما شاء
Sahih Ibn Hibban 10:238
, what do you mean now that you have sat for the second time to correct what we may have misunderstood from you? You are saying now fame; what fame do you mean?

The questioner : I mean by fame that there is no... between mutawatir transmission and ahad transmission regarding...

The Shaykh: So what?

The questioner : I mean if the intended meaning is that they say this...

Another questioner: Peace be upon you.

The Shaykh: And upon you peace.

The questioner : ... .

The Shaykh : I am forced to... your words without blame, I gave you, for example, the placing of the hands after ruku', so we wondered which of the two is more deserving of transmission, this or that?

The questioner : ... .

The Shaykh : How?

The questioner : The placing of the hands may have been hidden from those who completed the prayer with the Prophet (peace and blessings be upon him), but this is a matter; I mean, is this not the action of placing the hands?

The Shaykh : Is the action more prominent or the saying?

The questioner : The statement.

The Shaykh : No, the saying, they say the Messenger passed once and it was over, but the action he does in every prayer.

The questioner : It means it is repeated.

The Shaykh : Fine; so which of the two guidances—let us say now—should be transmitted?

The questioner : ... .

The Shaykh : Fine; which of the two guidances, the apparent one or?

The questioner: The action.

The Shaykh : The action, good; was this transmitted in the way that scholar wished the hadith of the Messenger that I mentioned earlier to be transmitted, or was this saying transmitted?

The questioner : ... .

The Shaykh : So then
None of you will have faith till he wishes for his (Muslim) brother what he likes for himself. لا يؤمن أحدكم حتى يحبَّ لأخيه ما يحبُّ لنفسه
Sahih al-Bukhari 13
, why is this narration rejected and this one accepted? Even though this one is more deserving of being famous as you wanted to correct your previous statement, and this one is not famous.

The questioner : Shaykh, it is not obligatory that it be corrected, meaning the responsibility of transmission is on me, I did not transmit from any of the early scholars, meaning.

The Shaykh : No, not from the early ones, from the contemporaries, I understood from you, you said you asked one of the scholars, I understood that, but this statement is not reasonable, I accuse you that you do not know how to transmit, and by Allah it is not reasonable for a noble scholar to come and condition a Prophetic Sunnah that he (peace be upon him) said must be this Sunnah, at first you said it was mutawatir or near mutawatir, now you corrected that statement and I accept that it be famous, what does famous mean? I mean is there one chain if it is hasan or sahih or must it have two chains or three or more?

The questioner : ... from the path of the chain, but rather from the path of transmitting actions it is from the Salaf, meaning...

The Shaykh: This is not an action, this is a statement, my brother.

The questioner : It is as if I understood what the brother wants to ask about; he says some of the Sunnahs that some of the youth do now, their general practice... like praying in sandals, or shortening the garment to the middle of the shin.

The Shaykh : No, my brother, do not widen the tear for the mender...

The questioner : ... corrects with the issue of transmission, and he—also—means another criterion they see, they say that this contradicts the action in the final tashahhud; because... the du'a is only in the final tashahhud, and the weak hadith is established that when he sits it is as if he is on a spear, he says that this.

The Shaykh : What do they argue with... with the hadith?

The questioner : Yes, that the Prophet (peace and blessings be upon him) when he sits it is as if he is on a spear.

The Shaykh : ... Is this authentic?

The questioner : No, it is a weak hadith.

The Shaykh : Fine; is it valid to argue with a weak hadith?

The questioner : It is not valid to argue.

The Shaykh : So then what is the value of this argument?

The questioner : I am not establishing, for example, or, I see, I agree with your statement regarding the saying of the Prophet (peace and blessings be upon him).

The Shaykh : Good, (peace and blessings be upon him), fine.

The questioner : But I face this uncle—may Allah reward him with good—with these matters.

The Shaykh : Look at your friend!

The questioner : He faced me with these matters, perhaps the expression failed me in the issue of his saying: if this matter had been famous from the Prophet (peace and blessings be upon him), it would have been transmitted, many of the Companions did it, then the Tabi'un, then so on, as the actions of prayer became famous, the condition is not that the chain be mutawatir or so.

The Shaykh : Fine; did every Sunnah become famous among the Companions and then among those who came after them?

The questioner: It may be...

The Shaykh : And here... what is the difference? Do you not know that Imam Malik when he enters the prayer—or at least Imam Malik is reported on this matter—the Malikis to this day when they enter the prayer: Allahu Akbar
[All] praise is [due] to Allah, Lord of the worlds - الحمد لله رب العالمين
[Al-Fatihah 1:2]
, they lost the reward of the opening takbir, and it is 12 types as I mentioned in "Sifat al-Salah", they lost the seeking of refuge, they lost the basmalah, and what else?

The questioner : The placement of the hands.

The Shaykh : And the placing of the hands, even though this is the most famous that can be from the perspective of other hadiths, a Sunnah may be hidden as we said earlier, on the occasion of the professor who was discussing with us that Imam al-Shafi'i says: "There is no one among us but that a Sunnah or two are hidden from him...", so this statement is still rejected, my brother, and no one from the people of knowledge can adopt it or assume it, otherwise many matters in which a single hadith came would be denied to him, and then is this statement in the science of usul?

The questioner: No.

The Shaykh : So why do we tire ourselves with opinions...?

The questioner : The prayer of tasbih—also—they say in it what we say... I mean what is the satisfying answer regarding these matters... the Sunnah, and like it the adhan, meaning saying: "Prayer is better than sleep," is it in the first adhan and some people say in the last adhan... many people argue with the issue of lack of fame or—for example—the issue that it contradicts the correct prayer.

The Shaykh : No, no, no, fine; what is your opinion on the famous hadiths from the tongues?

The questioner : ... .

The Shaykh : ... .

The questioner : I am convinced... I cannot...

The Shaykh : I desire now what is not desired, I desire that you see this scholar, this one you are pointing to who says this statement.

The questioner : This is an example, meaning not...

The Shaykh : No problem, I desire that I see one how a scholar speaks this statement and most of his worship is the opposite of what he theorizes and..., it is enough that this is a personal rule, no one mentioned it from the scholars of usul, and you know that this was said at first when you sat to speak; it was said in the creed—for example—that the hadith must be mutawatir, fine; but those who theorized this rule—and it is invalid regarding ahad hadith not being taken in the creed—they accepted ahad hadith in the rulings, how do we say we accept ahad hadith in the creed and then in some legal rulings the report must be famous?! My brother, is this fame the fame of Bedouins or the fame of..., undoubtedly it is not the fame of... the fame of..., then the fame of... the specialized scholars in knowledge or specialized in other than knowledge? They must be specialized in knowledge, fine; who among the scholars of hadith or scholars of usul conditioned the establishment of a legal ruling to be famous? And the famous among the scholars of hadith is what came from two paths or more, and they distinguished between the famous and the mufaddad with a detail I do not recall now, who said this condition? No one from the scholars said with this condition, so I ask you to rest yourself; the one who is saying this to you, be gentle withThe Shaykh : the noble one and say to him: I hope to be reassured by this rule; who said it from the people of knowledge? And are you—if you have, of course, the literary boldness to say to him—: and are you committed to it in all rulings of prayer, wudu, and purity and the like?

The questioner : ... .

The Shaykh : Yes?

The questioner : ... perhaps here he answers no.

The Shaykh : Fine; so then why there no and here yes?
