The questioner : The mother books of the previous scholars state: The scholars have agreed on such-and-such, and the scholars agreed on such-and-such in the era of such-and-such; so what is your opinion regarding the statement of al-Shafi'i and the statements of the other scholars?

The Shaykh : The statement of al-Shafi'i is the truth; because it is the one for which Imam al-Shafi'i provided evidence with the well-known verse:
And whoever opposes the Messenger after guidance has become clear to him and follows other than the way of the believers - We will give him what he has taken and drive him into Hell, and evil it is as a destination.
[An-Nisa 4:115]
, and the consensus whose violator and denier is included is this one. As for the other consensuses to some of which you referred earlier, they mean that they agreed on such-and-such. If they agree on something, it is permissible for a Muslim to contradict it with his own opinion if he has independent legal reasoning in it and is one of the people of independent legal reasoning. However, his contradiction is not like his contradiction of the first consensus. It is not permissible to contradict the first consensus absolutely.

The questioner : So we say that Ibn al-Mundhir's book "Al-Ijma'" is based on the second consensus?

The Shaykh : That is correct.

The questioner : May Allah reward you with good, peace be upon you.

The Shaykh : And upon you be peace and the mercy of Allah.

The questioner : This young man sent you this message.

The Shaykh : What is the matter with it? What is wrong with it?

The questioner : So this is a testimony from you.

The Shaykh : I have no testimonies.

The questioner : ... .

The Shaykh : I have no testimonies, my brother; people we do not know, do not associate with, and do not know their background.

The questioner : No, I will give you the message.

The Shaykh : My brother, just because he sends a message, do you know him?

The questioner : It is permissible to know him...

The Shaykh : You do not know him!!
Welcome, how are you? Welcome.

Another questioner: Peace be upon you.

The Shaykh : And upon you be peace... ... it is not prescribed in my opinion and independent legal reasoning, and then it was established; therefore, it is not prescribed.
