The Difference Between a Forward Sale and Excessive Uncertainty

Machine translationRead the Arabic original
Some farm owners buy, for example, fifty palm seedlings for fifty thousand, without specifying the type or size of the seedlings, but they stipulate that he must not sell anything until he receives the fifty that belong to him. If this is not permissible, what is your opinion regarding the urging of mosque imams to do this, since it is widespread? And if it is permissible, please issue a ruling for us. May Allah reward you with good.

There is no doubt that if he buys palm seedlings from him, it falls into two categories: The first category is that he buys them described in the debt. In this case, it is necessary to specify the type, quantity, and size.By the saying of the Prophet (peace and blessings be upon him): (Whoever makes a forward sale in something, let him make it in a known measure, a known weight, and for a known period),For example, he says: I bought from you one hundred sugar cane seedlings of the Barih variety for such and such an amount of dirhams.

The second category: As for if it is specific, such as if he says: I bought from you the seedling of this date palm, then it is necessary to specify the seedling, and it is not valid for it to be described; rather, he says: these ten seedlings, and he specifies them and names them by what they are known by. If it is not so, then it is unknown. And it is established in Sahih Muslim from Abu Hurayrah (may Allah be pleased with him): (That the Prophet (peace and blessings be upon him) forbade the sale involving excessive uncertainty).
