The Ruling on Photography with a Video Camera or a Photographic Camera
Machine translationRead the Arabic original
As for photography,The Prophet (peace and blessings be upon him) said: (May Allah curse the image-makers) Does the video camera fall under this hadith? No, it does not fall under this hadith, nor does photographic photography, because the photographer has not actually created an image; he has not drawn the face, the eyes, the nose, or the lips. The most he does is direct certain lights to capture an image of the thing, the image as it was created by Allah the Exalted. However, taking images is where the details lie. Here there are three categories: The first category: representational photography that is three-dimensional. This is forbidden for the photographer and for the buyer, because this is an image that rivals the creation of Allah the Exalted.
The second category: The image by hand, drawing,Meaning: where he draws the shape of a human, or a wolf, or a lion, or something similar. This is also forbidden according to the stronger opinion, even though some of the Salaf differed on this, but the stronger opinion is that it is forbidden.
The third category: The captured image, this does not fall under the hadith at all, because the one who captures it has not created an image. The most he does is press a certain button and the ray captures this image on the paper. This was not known in the time of the Prophet (peace and blessings be upon him) so that we could say: that the wording includes it by generality. And if we are in doubt about its inclusion in photography, and it did not exist in the time of the Prophet (peace and blessings be upon him), then a person cannot say: this man is cursed, or that these people are cursed. It is difficult. Entering into the warning without evidence or without knowledge is not permissible. A person must be scrupulous about declaring the lawful forbidden, just as he must be scrupulous about declaring the forbidden lawful. Indeed, the one who presumes to declare the lawful forbidden is more sinful than the one who presumes to declare the forbidden lawful. And this is with doubt, just as it is with certainty or suspicion. It is clear that one must follow what is predominant in his suspicion, because the forbidden is a ruling and a prohibition. A ruling in the domain of the right of Allah the Exalted is an error, because declaring things lawful or forbidden and judging belongs to Allah the Exalted. (Prohibition) : meaning: prohibiting people from what Allah has made lawful for them, while he did not know it was forbidden, and it was not predominant in his suspicion that it was forbidden.
