The Shaykh : To clarify the issue, I say: There is no difference between a Muslim leaving the fasting of the Day of 'Ashura or 'Arafah because it coincided with Saturday, and leaving the fasting of Monday or Thursday because it coincided with a day on which fasting is prohibited, such as the day of 'Id. The day of 'Id, the day of 'Id al-Fitr, is one day. If the day of 'Id coincides with Monday, does the Muslim fast? The answer is no. How is this contradiction resolved? There are hadiths in Monday encouraging fasting, and there is a prohibition in the day of 'Id against fasting. So what does the Muslim do when the prohibition conflicts with the virtue? The answer is: There is a jurisprudential rule that says: "When the prohibitive and the permissive conflict, the prohibitive is given precedence over the permissive." Just as you leave Monday and Thursday because of the coincidence with the day of 'Id, which is prohibited to fast, so exactly, and there is absolutely no difference, if you leave the fasting of the Day of 'Arafah or the Day of 'Ashura because it coincided with Saturday, there is no difference between this and that, were it not for the customs that have prevailed among many people, first of all, and especially since these customs are based on the opinion of many scholars. But Allah (Mighty and Majestic), as you all know, says:
And if you disagree over anything, refer it to Allah and the Messenger, if you should believe in Allah and the Last Day. That is the best [way] and best in result. فَإِنْ تَنَازَعْتُمْ فِي شَيْءٍ فَرُدُّوهُ إِلَى اللَّهِ وَالرَّسُولِ إِنْ كُنْتُمْ تُؤْمِنُونَ بِاللَّهِ وَالْيَوْمِ الْآخِرِ ذَلِكَ خَيْرٌ وَأَحْسَنُ تَأْوِيلًا
[An-Nisa 4:59]
