The Shaykh : First, my brother, we need to understand the form of the oath, because I think it will be clear from the title of the written document.

The questioner : Yes, of course, I think it is Article 19 of the law that it is obligatory after the election of the students and their attendance at the first session that the head of the students, meaning the head of the student council, should swear, "I swear by the Great Allah that I will be loyal to the nation, and for example, to the constitution and the laws of the university, and so on, and so forth, similar to this oath. Of course, this is not the only criterion; there are also other questions, meaning, there are others.

The questioner : Yes, the ruling of some brothers is that because of this, entering into it is forbidden.

The Shaykh : Yes, there is no doubt that as long as the election is based on, meaning, loyalty to the constitution, which is not Islamic, just as I told you, predicting in advance that it is clear from the title of the written document, this is not permissible. But if we assume that the oath was for the service of Islam, even so, I say that this is not sufficient, because Islam today has many concepts; there is, for example, socialist Islam, and this was explicitly present in the minds of many until recently, even if this socialist Islam has its effects in the hearts of many doctors and the like. It must be that the oath is very explicit, and it is, as we testify to Allah, the service of Islam according to the Book and the Sunnah and the methodology of the righteous predecessors. If the oath were on this clear, explicit basis, we would say: Is there participation in Islam? Before I say participation, is there in Islam holding elections and running for office by votes? This does not exist in Islam. And then comes the participation of women with men in the election. If it is clear from many quarters that it is clear from the title of the written document, then it is invalid and defective.
