﴿ فَاسْأَلُوا أَهْلَ الذِّكْرِ إِن كُنتُمْ لَا تَعْلَمُونَ ﴾

Is the one who denies a ruling from the rulings of Allah, such as jihad, described by the saying of Allah the Exalted: “Do you believe in part of the Scripture and disbelieve in part?”

The questioner : You said that I followed this question, and these are two observations I wanted to clarify. The two observations I will present to you now are through your answer to this first question?

The Shaykh: Yes.

The questioner : I know it perfectly well that it is in the minds of this young Muslim who wishes that I convey this matter to him. He asks: You said that most countries or lands do not rule by what Allah has revealed, so does it follow that some of them do rule by what Allah has revealed?

The Shaykh: Yes.

The questioner : And if this “some” exists, you said that among their deficiencies is that they have not declared jihad?

The Shaykh: Perfect.

The questioner : Does not the saying of Allah the Mighty and Majestic apply to such people who deny jihad, given that they have the capability, meaning weapons and armies? Does not the saying of Allah the Exalted apply to them, where He says:
So do you believe in part of the Scripture and disbelieve in part? Then what is the recompense for those who do that among you except disgrace in worldly life; and on the Day of Resurrection they will be sent back to the severest of punishment. And Allah is not unaware of what you do. أفتؤمنون ببعض الكتاب وتكفرون ببعض فما جزاء من يفعل ذلك منكم إلا خزي في الحياة الدنيا ويوم القيامة يردون إلى أشد العذاب وما الله بغافل عما تعلمون
[Al-Baqarah 2:85]

The Shaykh : I say this verse does not apply, my brother, because if this verse applied to these rulers, it would also apply to the individuals living under the authority of these rulers who do not implement some of the rulings of Islam. I mentioned earlier the hadith in which he (peace and blessings be upon him) said:
When you enter into the inah transaction, hold the tails of oxen إذا تبايعتم بالعينة وأخذتم أذناب البقر
Sunan Abi Dawud 3462Sahih (Al-Albani)
to the end of the hadith, and the second hadith is
Love of the world and dislike of death حب الدنيا وكراهية الموت
Sunan Abi Dawud 4297Sahih (Al-Albani)
. So if the mentioned verse applied to some rulers, there would be no difference at that point between these rulers and individuals from the Muslim masses who do not apply many of the rulings of Islam.
