The Shaykh : And for that reason, I mentioned in some of my books that among the evidence for the anomaly of the hadith of Mu'adh ibn Jabal, which states that the Messenger (peace be upon him), as the hadith claims, when he sent Mu'adh to Yemen, said to him:
By what do you judge? He said: By the Book of Allah. He said: If you do not find it? He said: By the Sunnah of the Messenger of Allah. He said: If you do not find it? He said: I will exercise my opinion and not fail. He (peace be upon him) said: Praise be to Allah, who has guided the Messenger of the Messenger of Allah to what the Messenger of Allah loves بم تحكم؟ قال: بكتاب الله قال: فإن لم تجد؟ قال: بسنة رسول الله قال: فإن لم تجد.؟ قال: أجتهد رأيي و لا آلوا قال عليه السلام: الحمد لله الذي وفق رسول رسول الله لما يحب رسول الله

When does a scholar resort to opinion? When he does not find an answer in the Sunnah. When does he resort to the Sunnah? When he does not find an answer in the Qur'an. This is incorrect. It is obligatory to combine the Book and the Sunnah together, because they both issue from a single source. Meanwhile, this hadith lowers the Sunnah in relation to the Qur'an to the status of opinion in relation to the Sunnah. When does he exercise his opinion and not fall short? When he does not find an answer in the Sunnah. When does he resort to the Sunnah? When he does not find an answer in the Qur'an. This is an error. The first is correct. When does he resort to opinion? When he does not find it in the Sunnah. When does he resort to the Sunnah? When he does not find it in the Qur'an. This is an error. Why? Now we ask: Is the carrion of the sea and the carrion of locusts lawful or forbidden? Allah the Exalted said:
Prohibited to you are dead حرمت عليكم الميتت
[Al-Ma'idah 5:3]
That is, we found the answer in the Qur'an, so it is not necessary to look
