Evidence for the Obligation of Zakah in Trade Goods

Machine translationRead the Arabic original
The Shaykh : Trade goods are subject to zakah. The evidence is the generality of the saying of Allah the Exalted:
Take, [O, Muhammad], from their wealth a charity
[At-Tawbah 9:103]
It is known that most of people's wealth, in terms of exchange, consists of trade goods. Another piece of evidence is the generality of the saying of the Prophet (peace and blessings be upon him) to Mu'adh ibn Jabal when he sent him to Yemen:
Inform them that Allah has made obligatory upon them a charity in their wealth, to be taken from their rich and returned to their poor.
Musannaf Ibn Abi Shaybah 4:30
It is known that trade goods are wealth. Among the evidences is the saying of the Prophet (peace and blessings be upon him):
Actions are only by intentions
The indication from this hadith
The student: ... he intended trade with it, so zakah became obligatory on it

The Shaykh : Now, the owner of the trade goods, what is his intention with these goods? Is he intending the wealth, which is gold and silver or what is equivalent to gold and silver, or is he intending the item itself?
The student: ...

The Shaykh : Okay, if he intends the item itself, will he sell it?
The student: ...

The Shaykh : But will he sell it, I ask?
The student: He will sell it

The Shaykh : Because the intended object is the item itself. A person who has a car and keeps it for his own riding intends the item itself; he cannot sell it. But a person who earns a living buys a car in the morning and sells it in the evening; is he intending the car, or is he intending the wealth, which is the equivalent of the car, to profit from it?
The student: The wealth, which is the equivalent of the car

The Shaykh : The wealth, which is the equivalent of the car, to profit from it. Rest. So, when the intended object of trade goods is their value, they fall under the saying of the Prophet (peace and blessings be upon him):
The reward of deeds depends upon the intentions and every person will get the reward according to what he has intended.
Sahih al-Bukhari 1
So, how many evidences do we now have, or how many evidences have we mentioned for the obligation of zakah in trade goods? No, my brother, a specific question, what is it?
The student: Trade goods

The Shaykh : Trade goods are subject to zakah. We said, what is the evidence?
The student: The evidence in it is ...

The Shaykh : There is no power or strength except in Allah. What is the evidence for the obligation of zakah in trade goods?
The student: The saying of the Prophet (peace and blessings be upon him)

The Shaykh : Rest. I want, especially from the students of knowledge, I want from the students of knowledge especially, that they have evidence for the issues. Because we are in a time when many people are not convinced if I say, "So-and-so said in such-and-such book this and that." Rather, they demand the evidence, whether their demand is out of good intention or out of stubbornness and opposition to the responsibility. People now, many of them, are not convinced if I say, "So-and-so said in such-and-such book." Rather, they say, "Where is the evidence?" So, we must, my brothers, we must know the evidences. We mentioned several evidences for trade goods from the Book of Allah and from the Sunnah of the Messenger of Allah (peace and blessings be upon him)
The student: ... the hadith of Mu'adh ...

The Shaykh : What is the hadith of Mu'adh?
The student: ...

The Shaykh :
Teach them that Allah

The student:
a charity (Zakah) to be taken from their rich and given to their poor
Sunan an-Nasa'i 2435Sahih (Darussalam)

The Shaykh :
A sadaqah in their wealth
It is necessary to mention this narration, the wording mentioned by al-Bukhari, which is one of the wordings of the hadith:
to pay the Zakat from their property and it is to be taken from the wealthy
Sahih al-Bukhari 1395
Okay, rest. Can we use as evidence for this the saying of Allah the Exalted:
O you who have believed, spend from the good things which you have earned and from that which We have produced for you from the earth
[Al-Baqarah 2:267]
?
The student: There is no evidence

The Shaykh : Why?
The student: Because this is sadaqah, not zakah

The Shaykh : Is sadaqah obligatory on what comes out of the earth?
The student: Yes, indeed

The Shaykh : On what comes out of the earth, so it is obligatory on what
The student: What comes out of the earth

The Shaykh : From what comes out of the earth. Okay, and it is obligatory on what we earned
The student: ...

The Shaykh : And the obligatory sadaqah
The student: It is not obligatory

The Shaykh : The obligatory sadaqah is not obligatory?!
The student: No, I say sadaqah is not obligatory, but zakah is obligatory

The Shaykh : Okay, rest
