The Shaykh : Third: Is an endowment restricted to a specific amount of wealth, or is it permissible for a person to endow everything he owns? The answer is the second: it is permissible for a person to endow everything he owns if he is not in the illness of death. If he is in the illness of death that is feared, he may not endow more than one-third of his wealth. This is because the dispositions of a person who is ill with a fatal illness, when death has befallen him, are limited to one-third or less. Accordingly, if this man has this house and nothing else, and he wants to endow it while he is healthy, frugal, and free from debt, we say there is nothing wrong with endowing this house, even if it is all his wealth. However, if he is ill with the fatal illness of death, he may not endow more than one-third of this house.
