The questioner : The honorable Shaykh saysThe questioner : My wife’s father passed away and left them an inheritance consisting of a group of currency exchange and tobacco. I mean, the origin of this inheritance is currency exchange and tobacco. What is the ruling on the inheritance, and what is the ruling on eating at her family’s home? Please give us a ruling, may Allah reward you.

The Shaykh : Yes, wealth acquired from tobacco is forbidden because tobacco is forbidden. And the Prophet (peace and blessings be upon him) said:
Indeed, when Allah forbids something, He forbids its price إن الله إذا حرم شيئاً حرم ثمنه
Sahih Ibn Hibban 26:35
As for wealth acquired from currency exchange, if a person conducts his exchange in accordance with the Shari'ah, such that he does not sell except hand-to-hand, and does not sell one type for another type except hand-to-hand and in equal amounts, then there is no harm in it, because it is one of the types of trade. However, if he falls into what is forbidden, it is wealth that deviates from riba (usury or interest), and the heirs inherit it after the one who engaged in riba, and the sin is upon the one who engaged in riba.
