The questioner : May Allah reward you with good. A questioner asks: O honorable Shaykh, if the saying and the action conflict, which is given precedence, and how do we know that a specific action, for example, is specific to the Prophet (peace and blessings be upon him)?

The Shaykh : Yes, he says: If the saying of the Messenger (peace and blessings be upon him) and his action conflict, which is given precedence? We say: First, the conflict between the saying and the action is not a trivial matter. Some scholars may believe that the saying and the action are in conflict, whereas there is no conflict between them. Pay attention, my brother. But if they conflict in every aspect and reconciliation is impossible, it is known that the saying is given precedence over the action. Otherwise, the original ruling is that each is a proof. Listen, Allah the Exalted said:
So when Zayd had no longer any need for her, We married her to you فلما قضى زيد منها وطراً زوجناكها
[Al-Ahzab 33:37]
Who is Zayd? Zayd ibn Harithah, the freed slave of the Messenger of Allah (peace and blessings be upon him and his family), whom he had adopted initially. They believed that an adopted son is like a real son; a man does not marry the divorced wife of his adopted son. They considered this an abomination. So Allah the Exalted said:
So when Zayd had no longer any need for her, We married her to you فلما قضى زيد منها وطراً زوجناكها
[Al-Ahzab 33:37]
The explanation is
in order that there not be upon the believers any discomfort concerning the wives of their adopted sons لكي لا يكون على المؤمنين حرج في أزواج أدعياءهم

So when Zayd had no longer any need for her, We married her to you فلما قضى زيد منها وطراً زوجناكها
[Al-Ahzab 33:37]
for the Prophet (peace and blessings be upon him). Then he said:
in order that there not be upon the believers any discomfort concerning the wives of their adopted sons لكي لا يكون على المؤمنين حرج في أزواج أدعيائهم
[Al-Ahzab 33:37]
This indicates that what is established for the Messenger (peace and blessings be upon him and his family) is established. Answer, everyone.
The student: For the believers

The Shaykh : For the believers. And when Allah wanted to specify the ruling for the Messenger, He explicitly stated the specification and said:
and a believing woman if she gives herself to the Prophet وامرأة مؤمنة إن وهبت نفسها للنبي
[Al-Ahzab 33:50]
Meaning, We have made permissible for you the woman who offers herself to you
if she gives herself to the Prophet [and] if the Prophet wishes to marry her, [this is] only for you, excluding the [other] believers إن وهبت نفسها للنبي إن أراد النبي أن يستنكحها خالصة لك من دون المؤمنين
[Al-Ahzab 33:50]
So the original ruling is that the saying of the Messenger is a Sunnah and his action is a Sunnah. But if they conflict in every aspect, the saying is given precedence. Why? Because the saying is clear in its indication, while the action may be specific to the Messenger, or the Messenger may have done it out of forgetfulness, or something similar to these possibilities. I will give you an example to look into. It is established from the Prophet (peace and blessings be upon him and his family) that he said:

The Shaykh : A saying? You differed on two sayings: a saying and no disagreement. Fine, this is a saying. And Ibn 'Umar (may Allah be pleased with him and his father) said:
I climbed up onto the house of Hafsah one day, and she is his sister, and I saw the Prophet (peace and blessings be upon him) relieving himself facing the direction of Sham and with his back to the Ka'bah. رقيت يوماً على بيت حفصة وهي أخته فرأيت النبي صلى الله عليه وعلى آله وسلم يقضي حاجته مستقبل الشام مستدبر الكعبة
How did he turn his back to the Ka'bah while he said, "Do not turn your backs to it"? Do we say that this is a conflict between the saying and the action? Al-Shawkani (may Allah have mercy on him), who is sufficient as a memorizer and scholar, said: "It is a conflict, and the saying is given precedence, and turning one's back to the Ka'bah is not permissible, just as facing it is not permissible. And he said, 'The action of the Messenger (peace and blessings be upon him) does not specify the generality.'" Because of the possibility that he forgot, the possibility that it was specific to him, or the possibility that he was compelled to do so. So we take the generality. And most of the scholars of knowledge said that reconciliation is possible: it is permissible to turn one's back to it in a building, but not in open space. Facing it is not permissible, neither in a building nor in open space. And this is the correct view. Based on this, I warn our Muslim brothers who built their bathrooms facing the direction of the Ka'bah, meaning the qiblah, to change it to another direction. The owner of the house might say, "By Allah, I just built the bathroom and I cannot afford it; it needs a pipe, it needs five hundred or a thousand riyals, and I hope that if I sit on it, I will turn away." We say this is possible, but will the person remain with this bathroom forever? He might sell the house, he might die and be inherited, and someone who faces the qiblah might come after him. Therefore, I advise my brothers who built their bathrooms facing the Ka'bah to change them, directing them either to the right, the left, or the back. So, what is the stronger position in this issue? The student: Reconciliation

The Shaykh : Reconciliation between them. We say: in open space, do not face it and do not turn your back to it. In a building, turn your back to it and do not face it. Yes.
