The questioner : Is it permissible to pray in a mosque part of which is on the edge of the road, and the other part is in the cemetery, given that it was built on the grave of a righteous wali?

The Shaykh : It is not permissible for a person to pray in a mosque built on a grave, that is, on a tomb, because the Prophet (peace and blessings be upon him and his family) said:
May Allah curse the Jews and Christians, for they took the graves of their Prophets as places of worship. لعنة الله على اليهود والنصارى اتخذوا قبور أولياءهم مساجد
Sunan an-Nasa'i 703Sahih (Darussalam)
. Therefore, this mosque is a forbidden mosque and it must be demolished.
However, if the mosque was old and then a dead person was buried in it, it is obligatory to exhume the dead person and bury him with the people. If that is not possible, we look to see if the dead person is in the direction of the qiblah; in that case, one does not pray toward the dead person. If the dead person is behind the qiblah, or to the right, or to the left, there is no harm in praying in this mosque.
