The Reciter: Isma'il narrated to us, saying: Malik narrated to me from Ibn Shihab from Urwah ibn al-Zubayr from Aisha, the wife of the Prophet (peace and blessings be upon him), that she said: كان عتبة بن أبي وقاص عهد إلى أخيه سعد بن أبي وقاص أن ابن وليدة زمعة مني فاقبضه إليك فلما كان عام الفتح أخذه سعد فقال ابن أخي قد كان عهد إلي فيه فقام إليه عبد بن زمعة فقال أخي وابن وليدة أبي ولد على فراشه فتساوقا إلى رسول الله صلى الله عليه وسلم فقال سعد يا رسول الله ابن أخي كان عهد إلي فيه وقال عبد بن زمعة أخي وابن وليدة أبي ولد على فراشه فقال رسول الله صلى الله عليه وسلم : هو لك يا عبد بن زمعة ، ثم قال رسول الله صلى الله عليه وسلم : الولد للفراش وللعاهر الحجر ، ثم قال لسودة بنت زمعة : احتجبي منه ، لما رأى من شبهه بعتبة فما رآها حتى لقي الله تعالى .
الشيخ : هذا الحديث أيضا سبق الكلام عليه وفيه أن القاضي يعمل بالحجة الشرعية وإن كان الأمر بخلافه فإن ظاهر الحال أن هذا الرجل كان لعتبة ابن أبي وقاص من أجل الشبه ولكن الفراش أقوى من الشبه ولهذا قال النبي صلى الله عليه وسلم : الولد للفراش وللعاهر الحجر ولكنه أمر سودة أن تحتجب منه هل هو من باب الاحتياط أو هو من باب إعمال الدليلين ؟ فمن العلماء من قال إنه من باب الاحتياط ومنهم من قال إنه من باب إعمال الدليلين والصحيح الأول لأن إعمال الدليلين هنا لا يمكن للتنافي فإنه إذا ثبت النسب انتفى وجوب الحجاب قطعا ولا يجمع بين متضادين لكنه من باب الاحتياط عمل النبي صلى الله عليه وسلمبما يقتضيه الحكم الشرعي من أن الولد لزمعة واحتاط في هذا الحكم بوجوب الاحتجاب من أجل الشبه البين نعم.

حدثنا إسحاق بن نصر حدثنا عبد الرزاق أخبرنا سفيان عن منصور والأعمش عن أبي وائل قال قال عبد الله قال النبي صلى الله عليه وسلم. Utbah ibn Abi Waqqas made a will to his brother Sa'd ibn Abi Waqqas, saying, "The son of the slave woman of Zuma'ah is mine, so take him into your care." When the year of the Conquest came, Sa'd took him and said, "He is my brother's son; he had made a will regarding him." Then 'Abd ibn Zuma'ah stood up to him and said, "He is my brother and the son of my father's slave woman; he was born on his bed." They went together to the Messenger of Allah (peace and blessings be upon him). Sa'd said, "O Messenger of Allah, he is my brother's son; he had made a will regarding him." And 'Abd ibn Zuma'ah said, "He is my brother and the son of my father's slave woman; he was born on his bed." The Messenger of Allah (peace and blessings be upon him) said, "He is yours, O 'Abd ibn Zuma'ah." Then the Messenger of Allah (peace and blessings be upon him) said, "The child belongs to the bed, and the adulterer gets the stone." Then he said to Sawdah bint Zuma'ah, "Veil yourself from him," because of the resemblance he saw between him and Utbah. She did not see him until she met Allah the Exalted. The Shaykh: This hadith has also been discussed previously. It indicates that the judge acts according to the legal evidence, even if the matter is otherwise. The apparent situation is that this man was the son of Utbah ibn Abi Waqqas due to the resemblance, but the bed is stronger than the resemblance.
