Is it permissible for a man to sell something he considers forbidden to a person who does not consider it forbidden?

Machine translationRead the Arabic original
The Shaykh : Yes

The questioner : Shaykh, may Allah reward you. Is it permissible for a Muslim who considers a specific item forbidden to sell it to someone who considers it lawful?

The Shaykh : Yes, yes. As long as the matter is a matter of ijtihad (independent legal reasoning), it appears there is nothing wrong with it. However, there is no doubt that scrupulousness (wara') lies in refraining from it. For example, if he sells tobacco to someone who believes it is lawful, there is no doubt that scrupulousness lies in not doing this, i.e., not selling it.

The questioner : Muslim mentioned it, and it is agreed upon by al-Bukhari and Muslim.

The Shaykh : What?

The questioner : The Muslim considers intoxicants (khamr) forbidden, while the disbeliever considers them lawful.

The Shaykh : Yes

The questioner : The issue.

The Shaykh : No, regarding this intoxicant, there is an explicit text (nass) concerning it, and it does not require figurative interpretation (ta'wil).

The questioner : Meaning, it is not permissible.

The Shaykh : It is not permissible, yes.
