Q: What is the ruling on the transfer of organs after the death of a person with brain death, as they say?

A: The Muslim is honored in life and in death, and it is obligatory not to expose him to what harms him or disfigures his creation, such as breaking his bones or cutting him up. It was reported in the hadith:
Breaking the bones of the deceased is like breaking his bones when he is alive.كسر عظم الميت ككسره حيًا
Sunan Ibn Majah 1616Hasan (Darussalam)
This is cited as evidence for the impermissibility of mutilating him for the benefit of the living, such as taking his heart or kidney or something else; because that is more severe than breaking his bone.
There has been disagreement among the scholars regarding the permissibility of donating organs. Some of them said: There is a benefit for the living in this due to the prevalence of kidney diseases, and this is subject to scrutiny. The closest view to me is that it is not permissible; because of the aforementioned hadith, and because there is tampering with the organs of the deceased and humiliation of him in that. The heirs may covet the money and not care about the sanctity of the deceased. The heirs do not inherit his body, but only his wealth. And success is from Allah.
