Q: If the deceased is a foreign worker and his family requests that he be transferred, and this would result in the removal of his internal organs, embalming, and placing him in a coffin, as well as imposing exorbitant costs on his guarantor, should his guarantor bury him where he died and disregard his family's request?

A: It is prescribed to bury the worker and others where they died, if they are Muslim, and they are to be buried in Muslim cemeteries. It is not permissible to transfer him if the transfer results in the desecration mentioned, such as the removal of his organs; because a Muslim is honored in life and in death. However, if the transfer results in religious matters that would be lost if he were not transferred, there is no harm in transferring him, provided that this does not result in desecration of his body, such as the removal of his organs or any part of them.
As for the worker, if he is a disbeliever, he is not buried in the Arabian Peninsula but is transferred to another location if that is possible; because the Prophet (peace and blessings be upon him) instructed to expel the disbelievers from this peninsula and said:
Two religions cannot coexist in itلا يجتمع فيها دينان
And success is from Allah.
