The author said -may Allah have mercy on him- in the book *Riyad al-Salihin*: "The chapter on the obligation of obeying those in authority in matters other than disobedience, and the prohibition of obeying them in disobedience to Allah": Then he provided evidence for this by the statement of Allah the Exalted:[An-Nisa 4:59] .
Those in authority: The scholars mentioned that they are of two types: the scholars and the rulers.
As for the scholars: They are the authorities of the Muslims in explaining the Shari'ah, teaching the Shari'ah, and guiding people to the truth. So they are authorities.
And as for the rulers: They are the authorities in maintaining security, protecting the Shari'ah, and compelling people to adhere to it. So these have a role and those have a role. The foundation is the scholars, because the scholars are the ones who explain the Shari'ah and say to the rulers, "This is the Shari'ah of Allah, so act upon it," and the rulers are bound by that. But if the rulers know the Shari'ah, and they have no way to know the Shari'ah except through the scholars, when they know the Shari'ah, they implement it upon the people.
The scholars have an influence on those who have faith and religion in their hearts, because the one who has faith and religion in his heart submits to the scholars and follows their guidance and commands. The rulers are obeyed by those who fear their power and have weak faith; they fear the ruler more than they fear the scholar, and some fear the ruler more than they fear Allah, may Allah protect us from that. Therefore, the Muslim community must have both scholars and rulers. It is obligatory upon the Muslim community to obey the scholars and to obey the rulers. But the obedience to these and those is subordinate to the obedience of Allah, by His statement the Exalted:[An-Nisa 4:59] And on this basis, if those in authority command disobedience to Allah, then there is no listening to them and no obedience, because above those in authority is the highest authority, Mighty and Majestic, who is Allah. So if they command what contradicts Him, there is no listening to it and no obedience.
