The Ruling on Marriage for the Purpose of Divorce (Tahleel)

Machine translationRead the Arabic original
Question: The brother / A. A. A. says in his question: I learned that a person dear to me divorced his wife three times, and thereby she became forbidden to him until she marries another husband. Is it permissible for me to marry her, then divorce her after a period of time, so that he may marry her after me? I know that I will not inform anyone of this intention of mine. Guide us, may Allah reward you with good, and make your reward great.

Answer: This action is not permissible for you; because this action is called marriage for the purpose of divorce (tahleel), and the Prophet (peace and blessings be upon him) cursed the one who does it and called it: the borrowed goat. So it is obligatory for you to beware of that, and it is an invalid marriage that does not make her lawful for her first husband. May Allah guide everyone to what pleases Him.
