The Shaykh : It is derived from these two hadiths: If a woman embraces Islam before her husband, she has the right to return to him, even after the waiting period, according to the hadith of Ibn 'Abbas without a new contract, and according to the hadith of 'Amr ibn Shu'ayb, she does not return except with a new contract.
If someone were to ask: Why do we not follow the path of preferring one over the other and say: The hadith of 'Amr ibn Shu'ayb indicates the establishment of a contract, so it is the affirming one, and the first is the negating one? The rule is that when an affirming statement and a negating statement conflict, we prefer the affirming one because it contains additional knowledge.
Well, we say in answer to this: Conflict requires equivalence. If the hadith of Ibn 'Abbas has a better chain of narration, there is no conflict, because the one with the better chain of narration is what? It is preferred. The one with the better chain of narration is preferred. For this reason, I mentioned to you that the Shaykh al-Islam Ibn Taymiyyah and his student Ibn al-Qayyim chose it.
