The Shaykh : He should choose the best person he can find in terms of knowledge and the best person he can find in terms of scrupulousness. Scrupulousness and asceticism are both about abstention, but scrupulousness is abstaining from what is harmful in the Hereafter, while asceticism is abstaining from what is not beneficial in the Hereafter. I believe there is a difference between them. Scrupulousness is that a person leaves everything that harms him, so he does not eat wealth without right, does not wrong anyone, and does not neglect any part of his work, and the like. Asceticism is leaving what is not beneficial, so he leaves permissible things in order to rise to the levels of perfection. On this basis, asceticism is higher than scrupulousness, meaning the station of asceticism is higher than the station of scrupulousness, because asceticism is leaving what is not beneficial. For example, we have three cases: a man who eats what is forbidden, a man who does not eat what is forbidden but does not exercise scrupulousness regarding things that have neither good nor harm, and a third man who leaves everything that has no benefit and does not eat it. The first has neither scrupulousness nor asceticism, the second has scrupulousness but no asceticism, and the third has both scrupulousness and asceticism, because one who is ascetic regarding what is not beneficial is, a fortiori, one who leaves what is harmful. The thing that is obligatory for a judge is that he be scrupulous, while asceticism is a matter of perfection. As for scrupulousness, it is necessary; it is necessary that the judge be scrupulous, meaning he is far from eating what is forbidden, such as bribery, favoritism, and the like. In his statement "knowledge and scrupulousness", he is completing the two pillars of guardianship, or rather the two pillars of every work, which are strength and trustworthiness, because all works are built upon these two pillars: strength in performing the work and trustworthiness in performing the work. Allah Blessed and Exalted is He said:
Indeed, the best of those you hire is the strong and trustworthy one إن خير من استأجرت القوي الأمين
A powerful one from among the jinn said, "I will bring it to you before you rise from your place, and indeed, I am for this [task] strong and trustworthy." وقال عفريت من الجن أنا آتيك به قبل أن تقوم من مقامك وإني عليه لقوي أمين
[An-Naml 27:39]
The precedence of strength over trustworthiness is evidence that it is more important than trustworthiness, because how many a person is trustworthy and one does not fear betrayal from him at all, but he is weak and produces nothing and yields no fruit. And how many a person is strong in performing his work but weak in his trustworthiness, so the second is better for establishing the work. For this reason, you find that many people who have strength, decisiveness, and management produce much more from their works than weak people who have trustworthiness. For this reason, the Prophet (peace and blessings be upon him) said to Abu Dharr:
You are a weak man, so do not take charge of a governorship or the wealth of an orphan إنك رجل ضعيف فلا تتولى إمارة ولا مال يتيم
or as he (peace and blessings be upon him) said. So a person must be strong and must be trustworthy. For this reason, the author began here with what? With knowledge, because it contains the strength for judgment, and then he concluded with scrupulousness, which is trustworthiness.
