He wrote a set of questions, saying: Your Eminence, may Allah preserve you: What are the conditions that must be present in those who engage in issuing fatwas and give rulings? And is it permissible for a person to issue a fatwa by transmitting from scholars whose knowledge is trusted? We ask you to speak to us on this topic, may Allah reward you, Your Eminence?
Answer: A fatwa is only permissible for a scholar who knows what Allah said and what His Messenger said. He has no right to issue a fatwa based merely on his own opinion.
So it is obligatory for the believer to issue a fatwa based on knowledge and insight regarding what Allah and His Messenger said. If he does not have knowledge, he should ask the people of knowledge whom he trusts and knows, and ask them about what is difficult for him. He should not flounder or speak without knowledge; for Allah said: [Al-A'raf: 33]. He placed speaking about Allah without knowledge above shirk (associating partners with Allah).
And it was mentioned regarding Shaytan that he commands evil and indecency [Al-Baqarah: 169].
