The questioner: He also says: In our country, in Yemen, the false accusation of women with zina has become widespread. There is no woman left, except what Allah wills, who has not been accused of zina. If a man tries to bring the witnesses mentioned by Allah in the Qur'an, he cannot do so. We have been unable to restrain people's tongues, and as a result, the lives of men and women have become filled with suspicion, illness, and waiting for misfortune. What is the way out of this? Please give us a ruling, may Allah reward you with the best reward, and may He guide you and preserve you.
The Shaykh: The way out of this is to establish the prescribed legal punishment. If someone falsely accuses a woman, the prescribed legal punishment is carried out against him, which is eighty lashes, as Allah the Exalted and Sublime has commanded, unless he brings four righteous witnesses to what he said. If he says, "She is a fornicator," and does not bring four witnesses, then she and her guardian have the right to demand the establishment of proof; otherwise, the punishment is carried out on his back. This is because Allah the Exalted and Sublime said:
And those who accuse chaste women and then do not produce four witnesses - lash them with eighty lashesوَالَّذِينَ يَرْمُونَ الْمُحْصَنَاتِ ثُمَّ لَمْ يَأْتُوا بِأَرْبَعَةِ شُهَدَاءَ فَاجْلِدُوهُمْ ثَمَانِينَ جَلْدَةً
[Surat al-Nur: 4].

This is because false accusation is not permissible except with proof. If she is chaste, known for uprightness and modesty, and there is no fault in her, then the punishment of eighty lashes is carried out against him. However, if she is not chaste, but is known for leniency in matters and suspicion, and it is not ruled that she is chaste, and it is not established before the judge that she is chaste, then she is given a discretionary punishment, meaning she is beaten what the judge sees fit: forty lashes, thirty lashes, twenty lashes, whatever the judge sees as a discretionary punishment for her. The accuser of a non-chaste woman is beaten what the judge sees as a discretionary punishment for him, to stop his tongue from exposing Muslims. Yes.
