Question:
From Rafah, the Arab Republic of Egypt, the questioner: (J. S. T) says: Your Eminence! What is the ruling of the Shari'ah in your view regarding a Muslim man who committed major shirk (associating partners with Allah)? Is he excused by his ignorance or not? When is a person excused by ignorance, and what is the evidence in both cases? May Allah reward you.
Answer:
Whoever commits major shirk (associating partners with Allah) has committed the greatest of sins, so it is obligatory for him to hasten to repent to Allah (Glorified and Exalted is He); because Allah says: [Surat al-Nur: 31] And He says (Glorified and Exalted is He): [Surat al-Zumar: 53] meaning: by shirk (associating partners with Allah) and sins [Surat al-Zumar: 53] The scholars are in agreement that this verse is regarding those who repent.
It is obligatory for anyone who commits any act of shirk (associating partners with Allah) or sins to hasten to repent and not to despair or lose hope; for Allah (Glorified and Exalted is He) has promised those who repent to Him that He will accept their repentance, and He is the Generous, the Noble , the Merciful, the Compassionate .
And whoever is among the Muslims, or to whom the Qur'an or the Sunnah has reached, the proof has been established against him, so it is obligatory for him to seek knowledge, ask questions, and learn until he clears his conscience, so that he is upon clear understanding.
As for whoever is in distant lands to whom the Qur'an and the Sunnah have not reached, it is said of him: he is from the people of the period of ignorance (al-fatra). His ruling is the ruling of the people of the period of ignorance. He is not a Muslim and not a disbeliever, but he is from the people of the period of ignorance, and his case is suspended until the Day of Resurrection. He will be tested on the Day of Resurrection; if he responds, he will enter Paradise, and if he disobeys, he will enter the Fire; because the call did not reach him.
As for whoever is among the Muslims, has heard the Qur'an, has heard the Sunnah, and the scholars are present, yet he turns away and does not ask and does not investigate, then he is not excused. We ask Allah for well-being. Yes.
