What is your opinion regarding the argument some people make for the permissibility of establishing a second congregation in the mosque, based on the hadith: “Who among you will give charity to this man? So Abu Bakr stood up and prayed with him”?

The questioner : That it is dragged along.

The Shaykh : That it is what?

The questioner : There are two forms: either establishing a new second congregation, or dragging along a follower to lead him in prayer. You said that it is not permissible in either form.

The Shaykh: Yes.

The questioner : Okay, and those who argue using the hadith of Abu Bakr:
Who among you will give charity to so-and-so or to this man?! أيُّكم يتصدَّق على فلان أو على هذا ؟!
So Abu Bakr stood up and prayed with him.

The Shaykh : I have heard our answer to this many times.

The questioner : No, I am sorry, my Shaykh.

The Shaykh : My brother, think about the congregation that is intended to be established after the first congregation has ended: who is the one giving charity, and who is the one receiving the charity?

The questioner : I do not know.

The Shaykh : You do not know.

The questioner: Yes.

The Shaykh : Because you cannot know, because they are all poor, so there is no rich person among them. I mean, those who missed the first congregation, they all missed twenty-seven degrees.

The questioner: Yes.

The Shaykh : So they are all poor compared to those who prayed in congregation. If one of them leads them, it cannot be said that he is the rich one and the follower is the poor one receiving the charity, or the reverse. It is not said. This is unlike the story mentioned in some weak narrations that it was Abu Bakr. In that, Abu Bakr prayed behind the Messenger of Allah (peace and blessings be upon him), so he first acquired the virtue of the rule, which is twenty-seven degrees.

The questioner: Yes.

The Shaykh : Then he acquired the virtue of praying behind the master of the nation, Muhammad (peace and blessings be upon him). So he is rich, and no one is richer than him. When he (peace and blessings be upon him) said to his companions who prayed behind him:
Is there any man who may do good with this (man) and pray along with him. ألا رجلٌ يتصدَّق على هذا فيصلِّي معه ؟!
Sunan Abi Dawud 574Sahih (Al-Albani)
- If we pass by a watermelon seller, we would like to know how much a large one costs, because it seems to be the last of its season - when Abu Bakr or someone else stood up and that man wanted to pray alone, he prayed behind him. He is the one who gave charity to this imam, because he made his prayer, which was supposed to be one... be new, I do not know.
The student : ... .

The questioner : Please, Shaykh.

The Shaykh : I say it has become clear to you. Abu Bakr, when he followed that man.

The questioner: Yes.

The Shaykh : Gave charity to him. Why? Because he was full of reward and merit that he acquired behind the Messenger of Allah (peace and blessings be upon him) first, and second: he was the one who was the cause of the congregation being formed, not the man who missed the congregational prayer.

The questioner : Does it imply that he was an imam?

The Shaykh : It would be understood from the words of the Messenger:
Is there any man who may do good with this (man) and pray along with him. ألا رجل يتصدق على هذا فيصلي معه
Sunan Abi Dawud 574Sahih (Al-Albani)
and not by him.

The questioner : Yes, okay. Here there are two virtues: the virtue that he followed, that he was with the Prophet (peace and blessings be upon him), and the second virtue is that he obtained the reward of the congregation. Okay, here, both virtues do not apply in the present time; only one virtue applies.

The Shaykh : And where?

The questioner : The virtue that he obtained the reward of the congregation, twenty-seven degrees.

The Shaykh : Where are you pointing to here?

The questioner : In the present time, only one virtue applies: that he obtained the congregation, twenty-seven degrees, in the first congregation.

The Shaykh : I and you entered the mosque after the first congregation had ended.

The questioner : No, I mean when he brought a late-arriving follower, my Shaykh, and followed him.

The Shaykh : My Shaykh, may Allah guide you. You mean a follower, meaning he dragged him and followed him. The form that was asked about, and which occurs, is that the imam says the closing salam, and a late-arriving person stands up.

The questioner: Yes.

The Shaykh : Okay, it is not that they dragged him; a late-arriving person stands up wanting to pray alone.

The questioner: Yes.

The Shaykh : A second person comes and follows him.

The questioner : Yes, yes.

The Shaykh: All right.

The questioner : This form is in it.

The Shaykh : In this form, what is there now? Who is the one giving charity and who is the one receiving the charity?

The questioner : There is no one giving charity and no one receiving charity here.

The Shaykh: Of course.
