He also asks and says: I live far away from my father, and my brother lives with my father in his house. My brother is married, and one day I went to take something from my father's house, but my brother's wife prevented me. I became angry and swore, saying: "Divorce is upon me if I enter this house," meaning my father's house, as long as I am alive. However, after that, I was unable to cut off ties with my father and entered the house. I request clarification of what is obligatory upon me, knowing that I intended: "Divorce is upon me" as an oath only, and I did not intend to divorce my wife. May Allah reward you with good?
Answer: If by this divorce you intended to prevent yourself from entering the house and to be strict with yourself, and you did not intend to effect the divorce of your wife if you entered the house, but rather you intended, as you said, an oath, meaning to prevent yourself from the house because of what your brother's wife did to you, then there is nothing upon you except the expiation of the oath, and the divorce does not take place. You must be dutiful to your father and visit your father, and you must not carry out this oath. Dutifulness to parents is among the most important matters, among the greatest obligations, and among the best deeds. So you must visit your father, and you must expiate your oath. The expiation is feeding ten poor people from the staple food of the land, giving each one half a sa' (a dry measure of about 3 kg) of the staple food of the land. Half a sa' is approximately one and a half kilograms of wheat, rice, or something else. Or you must clothe them, giving each one an undergarment and an overgarment, or a shirt. Or you must free a male or female slave, if that is available. If you are unable to do all of this, you must fast for three days.
