Question:
A listener from Iraq, whose name is Hasan Ismail Hussein al-Obaydi, sent a message containing a case in which he says: It is common in this time for a man to marry a woman with a prompt bridal gift of, for example, one thousand dinars, and a deferred portion of ten thousand dinars. Then he leaves the deferred portion for a long time without paying it to the wife, or until he dies. So what is the situation regarding zakah?

Answer:
She owes no zakah if he is unable to pay it. If he is unable to pay, she owes no zakah. However, if he is able to pay, then she must pay zakah on the deferred bridal gift; because whenever she demands it, she is entitled to take it, and its deferral is with her consent. So she owes zakah if he is able to pay, but if he is unable to pay, she owes no zakah. Yes.
