And the first letter of this episode came from the Yemeni listener Ahmad Abd al-Rahman Muslim al-Sha'bi, who says in his letter: Please give us a ruling, may Allah reward you, regarding a man who left his homeland sixty years ago, and we do not know to which country he went, nor do we know if he is alive or dead. However, when this man left his homeland, he had wealth, and he had a father and a brother from his father, and also a brother and a sister from his father only. We ask you to inform us who owns the property of the absent man, given that his father and his brother from his father and mother have died. Please inform us, may Allah reward you?
Answer: In the name of Allah, the Most Gracious, the Most Merciful. Praise be to Allah, and may Allah send blessings and peace upon the Messenger of Allah, upon his family and his Companions, and upon those who follow his guidance.
As for what follows:
This issue is one of the issues that is said to be among the matters of the missing person, and the ruling in it returns to the virtue of the judge of the country from which the missing person is from. So the judge looks into it and rules with what he sees after studying and inquiring about the man's condition and the reasons for his disappearance, and then after that he rules with what appears to him from the pure Shari'ah. The missing person has two states:
- A state in which destruction is the predominant possibility.
- And a state in which safety is the predominant possibility. The judge looks into it and attends to the matter, if Allah wills, and will be successful, and there is no solution for this except through the path of the Shari'ah court. Yes.
