Ruling on selling gold on credit
Machine translationRead the Arabic original
A message was received for the program from listener (M. H. S). Our brother says: I work in one of the jewelry shops in the Qassim region. As we know, it is not permissible to sell gold except for cash, and credit is not allowed in it. However, the shop owner says: If my known customers come, I give them credit. Is this correct or not?
Answer: Gold is not sold for gold except weight for weight, like for like, exactly equal. He does not have the right to sell it with an increase or for something absent. So, if he has a gold item, such as a bracelet, rings, necklaces, or otherwise, there is no harm in selling it for cash, hand to hand, in known paper currency, or in known silver, hand to hand. As for selling it for other gold, whether of the same purity or different purity, it is not permissible except with two conditions:
The first is equality in weight.
The second is the exchange of possession in the meeting. If they are not equal, he sells it to him, selling the item to him for cash in known currencies, such as the dollar, the Saudi riyal, or otherwise, hand to hand. As for selling gold for gold with an increase, it is not permissible. Giving a gold item for a gold item with an increase is not permissible. This is because when it was reported to the Messenger of Allah (peace and blessings be upon him) that a man bought a gold necklace containing beads, he said:Jami` at-Tirmidhi 1255Sahih (Darussalam). So, gold is sold weight for weight, like for like, and the beads are sold separately, so that there is no difference in the gold. He does not have the right to sell gold except like for like, exactly equal, hand to hand, if it is for gold. But if it is for something else, silver, or paper currency, there is no harm, but it must be hand to hand. And if he sells it for something other than currency, such as selling gold for sheep, camels, grains, or clothes, there is no harm even if it is not hand to hand. If he says: I am selling these gold rings or this bracelet to you for the sheep that so-and-so has, or the camel that he has, which you know, or the horse that you have, the sale is permissible even if the horse is absent and not taken possession of immediately, because it is not currency. Or if he sells it to him for land or a house, a building, selling many necklaces and bracelets for a house he has, or a shop, or known land, all of this is permissible, even if they separate without taking possession. Yes.
The presenter: So, is selling on credit permissible regarding gold, Your Eminence?
The Shaykh: If it is for something other than currency, yes, other than gold and other than known currency.
The presenter: For paper currency, for example?
The Shaykh: There is no harm in buying, for example, a necklace for land he has, or a camel or cow he has, a known house that he knows. Yes, even if they separate before taking possession of the cow, or the sheep, or the camel, or the land. Yes.
The presenter: But not for cash?
The Shaykh: As for cash, it must be hand to hand, whether the cash is paper or silver. If it is gold of the same type, it must be with equality in weight, weight for weight, like for like, if it is gold for gold, meaning, or silver for silver. Then the two conditions are necessary: equality in weight along with the exchange of possession.
The presenter: And those who buy new gold with old gold and pay the difference?
Answer: This is not permissible. Yes.
The presenter: May Allah reward you.
