Praise be to Allah alone, and peace and blessings be upon the one after whom there is no prophet. Then: The Permanent Committee for Scholarly Research and Ifta has reviewed what was sent to His Eminence the Grand Mufti from the Director of the Social Education Institute for Boys in al-Madinah al-Munawwarah , via the Head of the Courts in the al-Madinah al-Munawwarah Region, in his letter No. (567) dated 4/4/1416 AH, which was referred to the
Committee by the General Secretariat of the Council of Senior Scholars, No. (1746) dated 11/4/1416 AH. The questioner asked a question, the text of which is as follows: We present to your Excellency that we have a net amount of (444,559) four hundred forty-four thousand, five hundred and fifty-nine riyals, in the name of the orphans of the Social Education Institute for Boys in al-Madinah al-Munawwarah , which is the result of donations that were received by the institute when it was a private entity. The officials in the Ministry have decided to utilize this amount by forming a committee, and they wish to know the Sharia opinion regarding the channels through which it can be spent, such as: constructing buildings, maintaining the institute's facilities, or building sports fields, etc. We hope your Excellency will provide us with the Sharia opinion on this matter so that we can act accordingly. Please accept our sincere greetings and remain .
After the Committee studied the inquiry, it answered that if the matter is as stated, and the aforementioned donations are other than zakah, then it is permissible to dispose of them for the interests of the institute, such as constructing buildings or maintaining them, and the like of legitimate expenditures for the benefit of the orphans, provided that the donor did not specify a condition for what he donated. If he did, the amount must be spent according to the donor's condition. And whatever is zakah must be distributed to the poor orphans present in the institute.
