My uncle passed away (may Allah have mercy on him), but my father took over the company, which is managed by the sons of the partners. I advised my father to cancel the shares in that interest-based institution. My father passed away recently, and since his death, we have never spoken with my brothers and my uncle's sons about the inheritance. A notary public came to us and read to us the printed deed forms, which include sales, purchases, and investments, among which is the investment in those institutions. After that, he asked us to agree and sign. In my heart at that moment, I knew with complete certainty that investing in such an institution, and lending to or borrowing from it, is forbidden, but I could not say anything to the notary public because I was extremely concerned about my brothers' feelings. I wish they had read this form to me before the notary public arrived so that I could discuss it with them. Do I have any obligation, and what must I do now in this situation? The Shaykh : We say that this question contains two matters. One is investing with a company that deals in riba (usury or interest), which is forbidden and not permissible. If anyone deals in riba, it is not permissible to partner with him, because it will lead to riba entering the company's wealth, mixing the lawful with the forbidden, so investing in that is not permissible.
As for what you did by not clarifying the matter in front of the notary public, this is forbidden. It is obligatory for you to make your mindfulness of Allah the Exalted take precedence over everything, even over the feelings of your brothers and others, and to speak the truth. For Allah says:[An-Nisa 4:135] But after this matter has occurred, you can get rid of it by requesting a division of the estate and taking your share of this wealth, and disposing of it independently, or demanding that they remove this company that deals in riba from the rest of the wealth. If this is not possible, you must take your share of this shared wealth and deal with it in a way that does not involve riba. In this way, you will be rid of this action.
