Q: I bought a piece of land and wanted to buy another one adjacent to it for expansion. Since I was unable to buy it in cash, I turned to a company to buy it and sell it to me on installments. The company actually bought it after reaching an agreement with me on the installment price, the amount, and the duration. Now that the company has transferred the land to its name and taken possession of it, I would like to seek your ruling on the permissibility of my buying this land from them on installments, and whether there is any suspicion of prohibition or riba in it?
A: If the company has bought the aforementioned land and taken full possession of it, it is permissible for you to buy it from them because there is no prohibition. However, before the company buys the land and takes possession of it, it is not permissible for them to sell it, based on the saying of the Prophet (peace and blessings be upon him):Sunan Ibn Majah 2187Hasan (Darussalam) It is also not permissible for you to contract with them before that, until they own the land fully and it is in their possession. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his companions.
