Q: We inform Your Eminence that the Riyadh Development Company provides medical coverage for its employees, their children, and their spouses without compensation by paying their treatment bills at the medical facilities approved by the company, in accordance with a specific regulation for this purpose. The company is now moving to cancel this regulation and contract with one of the insurance companies to provide treatment for the employees and their families. This is done by the Riyadh Development Company paying a fixed annual amount in exchange for insurance covering the treatment of each person, regardless of whether the treatment costs during the year exceed or fall below the value of the fixed amount. We ask in this case: 1. Is it permissible for the company to sign an insurance contract with the insurance company? 2. Is it permissible for the company’s employees to benefit from the treatment provided under this contract? It is known that, according to the provisions of this contract, the employees are required to pay a specific percentage of their treatment costs, which is paid directly to the insurance company? 3. Does the ruling of the Permanent Committee for Scholarly Research and Ifta No.
( 20629 ) dated 13/10/1419 AH apply to this case? .

A: The medical insurance mentioned is a type of commercial insurance that is forbidden by the Shari'ah; because it contains excessive uncertainty, gambling, and consuming the wealth of people without right. A decision has been issued by the Council of Senior Scholars forbidding commercial insurance. Therefore, it is not permissible for the Riyadh Development Company to enter into this contract, nor is it permissible for its employees to benefit from it, nor to participate in it. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
