Q3: My grandfather on my father’s side passed away, and my father was young at the time. He left behind many lands, and these lands were not divided. They have been left as they are until now, to the point that their boundaries have been lost and some of them are no longer known. Is there a sin on my father for this? And likewise for my grandfather? And if my father passes away, is there a sin on him? Knowing that some of these lands have been divided, but not all of them. Please advise us, may Allah reward you with good.
A3: The lands left by the deceased belong to his heirs, who should divide them according to the Book of Allah the Exalted. They should refer to the court to have them divided among the heirs according to their inheritance shares. When the heirs, or some of them, request this, they should be accommodated to the extent possible.
